301. Zoning Districts.

The Township is divided into the districts set forth by this chapter and as shown by the district boundaries on the Official Zoning District Map. The zoning districts are:

 

C-D     Conservation District    

A-1      Rural Residential District          

R-1      Suburban Residential District     

R-V      Village Residential District        

B-1      Business District          

I-1       Industrial District

§302. District Boundaries.

Where uncertainty exists as to the boundaries of districts as shown on the Official Zoning District Map, the following rules shall apply:

A.        Boundaries indicated as appearing to follow the center lines of streets, highways or alleys shall be construed to follow such center lines.

B.         Boundaries indicated as appearing to follow platted lot lines shall be construed as following such lot lines.

C.         Boundaries indicated as appearing to follow municipal limits shall be construed as following municipal limits.

D.        Boundaries indicated as following railroad lines shall be construed to be midway between the main tracks.

E.         Boundaries indicated as approximately following the center lines of streams, rivers or other bodies of water shall be construed to follow center lines and, in the event of change in the location of streams, rivers and other bodies of water, shall be construed as moving with the actual body of water and following the center line.

F.         Distances not specifically indicated on the Official Zoning District Map shall be determined by the scale of the map. (Ord. 2007-2, 5/22/2007)

 

§303. General District Regulations.

The following regulations shall apply in all zoning districts:

            A.        Any use not specifically listed in the authorized uses for a zoning district shall not be permitted in that zoning district, unless such use is authorized by the Zoning Hearing Board as a use by special exception. The authority for the Zoning Hearing Board to grant approval of a use which is not specifically listed in the authorized uses for a zoning district shall be limited to the B-1 and I-1 Districts where "comparable uses not specifically listed" is included in the list of uses by special exception in the zoning district, subject to the applicable express standards and criteria specified in §1103, Subsection 10, of this chapter.

            B.         Accessory uses or structures that are customarily accessory to principal structures or uses that are authorized as conditional uses or uses by special exception shall be permitted as accessory uses by right.

            C.         In all C-D, A-1, R-1 and R-V Zoning Districts, where single-family dwellings either exist or are proposed, they shall be the only principal structure on a lot.

            D.        In all zoning districts where authorized by this chapter, two or more nonresidential buildings may occupy the same lot, and two or more authorized nonresidential uses may occupy the same building, provided, in all cases, that all applicable requirements for each of the structures or uses can be met on the lot.

            E.         In all zoning districts, all accessory structures shall be located on the same lot with the principal structure to which they are accessory. (Ord. 2007-2, 5/22/2007)

 

Part 4, C-D Conservation District

§400. Purpose.

The purpose of the C-D Conservation District is to preserve natural features and resources, particularly State game lands, and to provide for compatible principal and accessory structures.

§401. Authorized Uses.

In the C-D Conservation District, only the following uses are authorized:

            A.        Permitted uses.

                        (1)        Principal uses.

                                    (a)        Agriculture, subject to §1208.

                                    (b)        Communications antenna mounted on an existing building, public utility storage or transmission structure or existing communications tower, subject to §1211.

                                    (c)        Essential services.

                                    (d)        Forestry.

                                    (e)        Public buildings.

                                    (f)        Public recreation.

                                    (g)        Single-family dwellings.

 

                        (2)        Accessory uses. The following accessory uses are permitted when accessory to any permitted use, conditional use or use by special exception authorized in this district:

                                    (a)        Accessory structures, subject to §1203C.

                                    (b)        No-impact home-based businesses, subject to §1212.

                                    (c)        Off-street parking and loading, subject to Part 13.

                                    (d)        Private residential swimming pools, subject to §1203C.

                                    (e)        Signs, subject to Part 14.

Other accessory uses customarily incidental to and on the same lot with any permitted use, conditional use or use by special exception authorized in this district.

            B.         Conditional uses.

                        (1)        Principal uses.

                                    (a)        Cemetery, subject to §1103, Subsection 8.

                                    (b)        Mineral extraction, subject to §1103, Subsection 24.

                                    (c)        Oil and gas drilling, subject to §1103, Subsection 29.

                                    (d)        Shooting range, subject to §1103, Subsection 36.

                        (2)        Accessory uses: none.

 

            C.         Uses by special exception.

                        (1)        Principal uses.

                                    (a)        Communications tower, subject to §1103, Subsection 9.

                                    (b)        Noncommercial recreation, subject to §1103, Subsection 28.

§402. Area and Bulk Regulations.

In the C-D Conservation District, all uses shall be subject to the following regulations, except as they may be modified by the express standards and criteria for the specific conditional uses contained in Part 11:

§500. Purpose.

The purpose of the A-1 Rural Residential District is to provide for agriculture and low-density single-family residential development in rural areas of the Township where public sewers are not available and to provide for accessory uses and compatible public and semipublic uses as conditional uses.

§501. Authorized Uses.

In the A-1 Rural Residential District, only the following uses are authorized:

            A.        Permitted uses.

                        (1)        Principal uses.

                                    (a)        Agriculture, subject to §1208.

                                    (b)        Boarding stable, subject to §1208.

                                    (c)        Churches.

                                    (d)        Communications antenna mounted on an existing building, public utility storage or transmission structure or existing communications tower, subject to §1211.

                                    (e)        Essential services.

                                    (f)        Forestry.

                                    (g)        Garden nursery or greenhouse, subject to §1208.

                                    (h)        Kennel, subject to §1208.

                                    (i)         Pet grooming.

                                    (j)         Public buildings.

                                    (k)        Public recreation.

                                    (l)         Schools, public or private.

                                    (m)       Single-family dwellings.

 

                        (2)        Accessory uses. The following accessory uses are permitted when accessory to any permitted use, conditional use or use by special exception authorized in this district:

                                    (b)        No-impact home-based business, subject to §1212.

The purpose of this district is to encourage single-family developments at suburban densities in locations in the Township where public sewers exist or are anticipated in the future and to provide for accessory uses and compatible public and semipublic uses as conditional uses.

In the R-1 Suburban Residential District, only the following uses are authorized:

            A.        Permitted uses.

                        (1)        Principal uses.

                                    (a)        Churches.

                                    (c)        Essential services.

                                    (d)        Forestry.

                                    (e)        Public buildings.

                                    (g)        Schools, public or private.

                                    (h)        Single-family dwellings.

 

                        (2)        Accessory uses. The following accessory uses are permitted when accessory to any permitted use, conditional use or use by special exception authorized in this district:

The purpose of this district is to preserve the established neighborhoods in the Township where higher-density housing already exists, to provide additional opportunities for higher-density housing and to allow for limited commercial uses to serve the residents in appropriate locations along main streets in these villages. §701. Authorized Uses.

In the R-V Village Residential District, only the following uses are authorized:

            A.        Permitted uses.

                        (1)        Principal uses.

                                    (e)        Business services.

                                    (f)        Commercial recreation.

                                    (h)        Communications antenna mounted on an existing building or public utility storage or transmission structure, subject to §1211.

                                    (i)         Contracting business.

                                    (j)         Convenience store.

                                    (k)        Day-care center.

                                    (l)         Essential services.

                                    (m)       Forestry.

                                    (n)        Garden apartments existing on the date of adoption of this chapter.

                                    (o)        Garden nursery.

                                    (p)        Indoor amusement.

                                    (q)        Laundromat.

                                    (r)        Motel/hotel.

                                    (s)        Personal services.

                                    (t)         Pet grooming.

                                    (u)        Public buildings.

                                    (v)        Public recreation.

                                    (w)       Repair shop.

                                    (x)        Restaurant, including fast-food restaurant.

                                    (y)        Retail businesses.

                                    (z)        Single-family dwellings existing on the date of adoption of this chapter.

                                    (aa)      Vehicle accessory sales and installation.

 

                        (2)        Accessory uses. The following accessory uses are permitted when accessory to any permitted use, conditional use or use by special exception authorized in this district:

                                    (a)        Drive-through facilities, subject to §1206.

                                    (b)        Off-street parking and loading, subject to Part 13.

§900. Purpose.

The purpose of this district is to provide for a mix of heavy commercial and light industrial uses in appropriate locations in the Township on sites that have adequate area to accommodate the uses and that can be reasonably buffered from adjoining zoning classifications.

In the I-1 Industrial District, only the following uses are authorized:

            A.        Permitted uses.

                        (1)        Principal uses.

                                    (a)        Bar or tavern.

                                    (b)        Business or professional offices.

                                    (c)        Business services.

                                    (d)        Commercial recreation.

                                    (e)        Commercial school.

                                    (f)        Communications antenna mounted on an existing building, public utility storage or transmission structure or an existing communications tower, subject to §1211.

                                    (g)        Contracting business.

                                    (h)        Contractor's yard.

                                    (i)         Essential services.

                                    (j)         Garden nursery.

                                    (k)        Light manufacturing.

                                    (l)         Repair shop.

                                    (m)       Research and development.

                                    (n)        Restaurant, including fast-food restaurant.

                                    (o)        Supply yard.

                                    (p)        Warehousing and distribution.

                                    (q)        Wholesale business.

 

                        (2)        Accessory uses. The following accessory uses are permitted when accessory to any permitted use, conditional use or use by special exception authorized in this district:

 

                                    (a)        Off-street parking and loading, subject to Part 13.

                                    (b)        Signs, subject to Part 14.

                                    (b)        Heavy manufacturing, subject to §1103, Subsection 18.

§902. Area and Bulk Regulations.

In the I-1 Industrial District, all uses shall be subject to the following regulations, except as they may be modified by the express standards and criteria for the specific conditional uses and uses by special exception contained in Part 11:
