C.     Police Reports: Quarterly Report: Calls received-336, Calls answered 336, Court Hearings-13,  Magistrate Hearings-52, Arrests: 25 Non-traffic, 37 traffic and 22 accidents.

D.     Supervisors Report:

1.      Subdivisions:

a.       Peter Blue Jr./Leah Attanucci: Joe motioned to approve subdivision, Bill second, Passed.

b.      Raymond Zalaznik/Eric Roach-Tom motioned to approve subdivision, Bill second, Passed.

2.      Berggren & Turturice/ Smith Township vs Risker: Berggren and Turturice has filed a brief in behalf of Smith Township and Risker has thirty days to file his brief.

 

IV.              Correspondence:

A.     Smith Township/Rytis Balciunas: Rytis is the chairman of Smith Township Zoning Hearing Board. The Smith Township supervisors have sent a letter of thank you to Rytis for all the work done on the computers at the township offices. He found the cheapest price for the new Dell Computer. He has used vacation time and personal time to help set the new system and the supervisors wanted to acknowledge all the work he has done free for the township.

B.     Comm. of PA Human Relations Commission-Officer Larry Bonazza vs Smith Township:, July, 2002: PA Human Relations Commission has investigated the above referenced complaint of unlawful discrimination and has deteremined that the complaint should be dismissed because the facts of the case do not establish that probable cause exists to credit the allegations of unlawful discrimination. Enclosed is a Notice of the complainants further rights in this matter.                                                                                                                                                                                                                                                                                                                                                                                                                             

C.     DCED-The supervisors have been notified that the grant filed with DCED for $5,000.00 for existing equipment has been approved.

D.     DEP/ The supervisors have sent a letter to Bob Tedjeske, DEP about two residents in the township having problems with mine water. Don Hucticko, 62 Bavington Road and Chris Orison, 288 Francis Mine St. Road. Mr. Tedjeska will come out and look at the problems with the supervisors.

E.      PA American Water Co. The supervisors have requested two new hydrants be installed in Bulger, PA when they are installing the new water lines. They will be located on Pleasant Valley Road and Grant Street Circle.

 

V.                 Old Business

A.     Part time Police Officers: Chief Robert Kings is retiring July, 1, 2005. He is presently taking his vacation time and using up his accumulated sick time. Four of the present part time officers have taken other jobs. Two went to full time positions, one part timer has been sick for over a month and the other has taken a part time job with a possibility of full time in another police department and when he was scheduled for Smith he had to call off. We have a problem filling all twenty one (21) shifts at present. We need to hire at this time. The supervisors interviewed six applicants.  The three qualified and will be considered for the position are Aaron J. Vanatta, Ronald T. Bernick, Jr. and Billy F. Nichols. Bill motioned to hire the above named applicants, Joe second, Passed. Joe will meet with them and set up starting dates for training.

B.     Resolution # 2005-5R/Hanover Sewer Authority:  The final paragraph: Now, therefore be it resolved that the supervisors of Smith Township hereby adopt and submits to the Dept. of Environmental Protection for its approval as an amendment to the official plan of the municipality for the above reference facility plant. The Hanover Township Sewage Authority by resolution assures the department of the complete and timely implication of said plant as required by law. The selected alternative is to implement Phase I  Paris grinder pumps, low pressure sewers and pump stations to collect and convey waste water to the Weirton System for treatment and for Phase II is a combination of low pressure sewers, gravity sewers, pump stations to collect and convey waste water to a new 180,000gpd treatment plant in Bavington. The estimated cost for the alternative is $13,328,378.00 which will result in a monthly user fee ranging from $56.00 to $68.00 a month depending upon funding. The key implication activities include the necessary permits and financing and the start and completion of construction.

 

This will include Smith Township in the Bavington area. It will also include part of Robinson Township (Washington County).

 

Joe motioned to pass Resolution 2005-5R, Bill second, Passed.

 

    1. Resolution # 2005-4R CDBG Block Grants-(Last paragraph) Now, Therefore, Be it Resolved, that Smith Township hereby calls on the Congress to preserve the Community Development Block Grant Program within the Department of Housing and Urban Development and provide a FY 2006 funding of at lease $4.7 billion overall, with no less than 4.35 billion in formula funding. Since 1992 Smith Township Supervisors have received over $350,000.00 from the Community Development Block Grants to improve the road system. Grants are available to the communities ever three years, we receive at present approximately $65,000.00 which assist our resident of low and moderate income through public improvement projects, such as roads, storm boxes, storm drains, recreation and etc.

Bill motioned to pass resolution 2005-4R, Joe second, Passed.

 

    1. Ordinance 2005-1-Midway Sewage Authority Refinancing: Guarantee of Loan and Loan Agreement for the 2.3 % responsibility of Smith Township. Bill motioned to pass Ordinance 2005-1, Joe second, Passed.  Roll call: Tom-yes, Joe-yes, Bill-yes.

    2. Ordinance 1985-2 (Firearms Ordinance) Information forth coming, no action taken until all legal aspects are reviewed.  Mr. James Greer has presented the township supervisors with petitions signed for the updating of this ordinance.

 

 

Comments:

In response to Donald Suica starting to ask again about roadmasters: Tom stopped him and responded: saying this issue of roadmasters has been brought up several times by Mr. Suica and has been addressed each time. Also, at the regular meeting in April, you, Mr. Suica made a comment and questioned the supervisors as not addressing a letter to the supervisors from Mr. Richards on roadmasters. I will at this time clarify by reading from the November 8, 2004 Old Business, Section B. Roadmaster/Hand deliver letter. Tom said Mr. Richards on, September 13, 2004, hand deliver a letter. The contents of the two page letter stated that Mr. Richards felt that only one Roadmaster can be appointed. Tom said this was brought up by Mr. Suica before at prior public meetings. Tom read the report from Solicitor Robert Clarke. There is absolutely nothing wrong with one serving as a roadmaster. I have researched this issue and have also discussed it the Pennsylvania State Association, and there is no limitation as to the amount or number of Supervisors serving as roadmasters. Tom said he would end this discussion by saying Mr. Richards fight is with PA. State Association of Twp. Supervisors, State Legislators of the courts. I end this by saying to you Mr. Suica as was said to Mr. Richards: your fight is with the PA. State Association, State Legislators and the Courts. There will be no more discussion at this meeting on this issue.

 

Jim Haley, Bulger, PA. His concern is with the abandoned bridge that is owned by Penndot in Bulger, He was looking at the bridge planks and they are rotten. He is afraid a child will fall through and get hurt. He believes this is a critical situation and the supervisors need to notify Penndot. The supervisors agreed to notify Penndot about the situation.

 

Donald Zalaznik: Tonight I sat here and listened to you talk about the merger with Hanover Sewage Authority and Midway Sewage Authority.

Tom: This is not a merger.

Don: I think you should thank the people who have served on the committee for the merger. They have donated a lot of time and effort.

Tom: The supervisors have thanked them more than once.

 

Vince Scalise: Water coming of the state road (Grant Street) and flooding my basement. They were out but I have not heard back from them.

Joe: I will call Penndot and find out what is going on.
